About 90% of buyers who ask for “OEM” actually need ODM. Real OEM — you own the design, the factory builds to your drawings — only makes financial sense above roughly 50,000 units a year. Below that, the tooling cost never amortises. Yet the word “OEM” appears in most RFQs because it sounds more serious than “ODM.”
Here is what each one actually costs and actually buys.
That last row is the one that surprises people. OEM is more expensive per unit until you pass roughly 10,000 units, because the tooling and engineering cost is amortised over a small run. Below that threshold, ODM is cheaper and faster, and the only thing you give up is design ownership.
Under ODM, the factory designed the circuit, so the factory holds the CE / CB / UL certificate. You are permitted to sell under it — usually with your name added as an additional listing — but you do not own it.

This is the most under-negotiated clause in B2B power supply purchasing. Put it in the contract: who holds the certificate, what happens on termination, and how much notice you get before a BOM change.
Buyers fixate on the 2,000–8,000 tooling figure and ignore certification entirely. On a genuinely new design:

For a North American launch, certification routinely exceeds tooling. And unlike tooling — which you could theoretically move to another factory — certification money is unrecoverable if you change suppliers.
More than most buyers assume, at MOQ 50 pcs:
What you cannot change under ODM: the PCB layout, the topology, the transformer, and the housing shape. Those are OEM.
One more branch worth naming: if your differentiation is software, packaging or service rather than hardware, ODM is almost always right. Paying for a unique housing to compete on a spec nobody reads is the most common way to burn a tooling budget.
